Nursing Home Responds to Claims of Negligence
ABOUT THE CLIENT
A skilled nursing facility with 140 beds, located in a metropolitan area of the Midwest, that provides a spectrum of clinical care services to patients residing at the facility. The facility patient mix includes both Medicare and Medicaid, as well as other payer types.
THE CHALLENGE
The family of a resident who had fallen and suffered an injury brought a lawsuit against the facility, alleging that the facility was negligent due to insufficient staffing. Marcum was engaged by the attorney representing the facility to solicit our professional review of documentation and expert testimony.
THE GOAL
Assess the client’s compliance with industry and regulatory requirements for facility staffing levels.THE PROCESS
Marcum’s professionals researched staffing requirements; completed a staffing analysis; reviewed the deposition of the opposition, identifying errors in the testimony; and participated in a deposition.
THE SOLUTION
The Marcum research and analysis validated that the facility met staffing requirements and industry guidelines and that the facility was not negligent in the fall and injury of the resident. The case was dismissed.
