Tax Controversy

In September 2013, the IRS released final regulations (“regs”) regarding repair/capitalization rules for tangible property, with an effective date of January 1, 2014. The IRS estimates that 4 million taxpayers will be affected by these regulations.

On Monday, Dec. 2nd, the U.S. Supreme Court officially denied Certiorari to Overstock.com and Amazon.com petitions seeking to overturn New York’s law requiring sales tax collection by certain Internet retailers, even if they have no physical presence.

The President’s home state of Illinois has become the 16th state to recognize same-sex marriage. The law is effective June 1st, 2014. Illinois previously allowed civil unions, but now joins California, Connecticut, Delaware, Hawaii, Iowa, Maine, Maryland, Massachusetts, Minnesota, New Hampshire, New Jersey, New York, Rhode Island, Vermont, Washington, and the District of Columbia in the legalizing of same-sex marriage.

As of November 13, 2013, Hawaii has become the 15th state to recognize same-sex marriages. The law is effective December 2, 2014. Hawaii led the same-sex marriage debate in 1993 when a Hawaii Supreme Court decision ruled that two women's rights to equal protection under the law were violated by not allowing them to get married.

The Internal Revenue Service (IRS) has recently released Notice 2013-61, which provides optional administrative procedures that employers can use to correct overpayments of Federal Insurance Contribution Act (FICA) taxes for 2013 and prior years on a simplified basis.

On June 26, 2013, the Supreme Court ruled Section 3 of the Defense of Marriage Act (DOMA) unconstitutional. In doing so, the Court has allowed the definition of “marriage” to be determined at the state level.

With the overturning of the Defense of Marriage Act (DOMA) by the United States Supreme Court today, same-sex couples who were legally married in the 12 states that recognize their marriages, plus the District of Columbia, can now take advantage of the more than 1100 federal benefits that heterosexual married couples have been entitled to.
